Notice of Filing Fee Increases

Several new filing fee and cost increases in the State and Magistrate Courts of DeKalb County took effect May 17, 2010.

Notice of Filing Fee Increases
HB 1055 became effective upon approval by Governor Sonny Perdue on May 12, 2010. Pursuant to HB 1055, there are several new filing fees and costs in the State Court of DeKalb County and the Magistrate Court of DeKalb County. The fee increases were implemented in the State Court and Magistrate Court in DeKalb County on May 17, 2010. Please note the following:

State Court
All suits or proceedings of any character: $210.50
(includes first judgment, writ of fieri facias (fi. fa.) and recording of same)
Dispossessory/Distress Warrant: $202.50
(includes service on one (1) defendant)
Post-Judgment Motions: $210.50
(If filed more than 30 days after entry of final judgment – where fee has been paid on motion to compel, no additional new case fee will be required for filing motion for contempt concerning same post-judgment discovery)(Pursuant to an order signed September 14, 2007)

Magistrate Court
All Suits or Proceedings of any character: $51.50
(service for each defendant is $25)
Dispossessory/Distress Warrant: $51.50 (service for each defendant is $25)
Criminal warrant application fee: $20
Writ of fieri facias (fi. fa.): $9.50
Please note that because the State Court Marshal serves papers for State Court and Magistrate Court in DeKalb County, the new Sheriff’s service fee of $50 does not apply. Marshal’s service remains at $25. Additionally, with respect to the per page charge for preparation of the record to the appellate courts, the State Court of DeKalb County is governed by local legislation, Ga. Laws 2002, p.4604, section 11B, which provides for a charge of $1.50 per page as opposed to the $10 per page charge provided for by the recently amended O.C.G.A. § 15-6-77(g)(12). That section is explicitly applicable to the Superior Courts.
